Button Battery Lawsuit

The vast majority of parents take their responsibility to care for their children’s health seriously. They are selective in choosing the toys that their children will play with, the food that they will eat, and the environment that their children will be in. They decide all of these things based on what appears to be in the best interest of their child.
Unfortunately, loving and caring parents have had to endure the unthinkable as they watched their child suffer damage after ingesting a button battery.
What Is a Button Battery?
A button battery is a small, shiny battery that is usually about the size of a small coin. These batteries have been used in a wide range of appliances, including digital cameras, remote controls and even in children’s toys. Because of their size and shiny appearance, they are attractive to small children who do not recognize the danger they pose.
The Danger of Button Batteries for Small Children
When a child swallows a button battery, a whole range of internal and external injuries can occur. First, the child is at risk of choking on the battery. Second, the battery may get stuck in the child’s esophagus when they swallow it. When this happens, there is an electrical charge that begins to build up around the battery. This electrical charge causes painful internal injuries, damages tissue, and can produce serious and often times fatal chemical burns.
Medical professionals have seen a direct link between the increase in the use of button batteries and in the amount of children who end up in the emergency room every single day. Toy manufacturers and the manufacturers of remote controls and other small devices have the responsibility of seeing to it that these small batteries are securely placed inside of the devices they power. Failure on the part of these manufacturers to safely secure button batteries may equate to negligence on their part.
Parents who have had to the painful experience of watching their children suffer severe injury as a result of swallowing button batteries often times feel frustrated, angry and helpless. They may think that there is no one who will be held responsible for the negligence that led to their child’s injury. This is not necessarily the case. If your child is suffering the results of swallowing a button battery, speak to a personal injury lawyer today. Let them explain to you the legal options that are available when it comes to getting compensation not only for the medical bills associated with treating the child, but also for the pain and suffering that both you and your child have experienced.
The Responsibility That Manufacturers Have
Manufacturers have the responsibility to produce a product that is going to be reasonably safe to use. When there is evidence that a product that they are producing is potentially dangerous, they have the responsibility to warn the public of that danger, take steps to remove the dangerous product from circulation and make changes to their product so that any safety concerns are dealt with.
When it comes to the dangers associated with button batteries, there is more than enough evidence proving how dangerous they can be. Between the years 2009-2010 there were seven children who lost their lives as a result of ingesting button batteries. The fact that ingesting button batteries affects mostly small children is seen in the fact that more than 70 percent of the emergency room cases that involve button batteries were for children who were under the age of four.
Collaborating this is information that was published by the journal Pediatrics. This journal stated that in the nineteen year period between 1990 and 2009, more than 60,000 children visited the emergency room as a result of injuries associated with swallowing these small batteries. From the time this information was recorded the yearly number of visits to the emergency room because of ingesting button batteries more than doubled.
Why Manufacturers Are Held Responsible
Some people argue against holding manufacturers responsible for children ingesting these batteries. They say the responsibility lies squarely with the parents. In assertiveness, they are ignoring the fact that manufacturers do bear the responsibility of producing products that are safe. When it is brought to their attention that multiple individuals are being injured by a product that they are producing, they have the legal and moral responsibility to take steps to fix it.
Many individuals are calling on manufacturers, especially those who work in the electronic industry, to take the danger posed by button batteries to children more seriously. They want manufacturers to help in raising awareness about the dangers that these button batteries pose.
In many cases, children are brought to the emergency room and the parents do not even suspect that swallowing a button battery is the reason why the child is not feeling well. If manufacturers did a better job of explaining the dangers posed by these batteries, parents and caregivers would know to include swallowing button batteries as a thing to check for if their child develop certain symptoms.
Many are also asking manufacturers to design their products in a way that makes it difficult to remove these button batteries. This may include designing their apparatuses with safety features similar to those used on prescription and nonprescription pill bottles to prevent children from inadvertently accessing them.
Finally, companies that design button batteries are being called on to change the way that the battery is designed, thereby making it less harmful if swallowed. Battery designers and manufacturers are being urged to develop stronger warnings and to increase their safety standards in order to minimize the danger that their product poses to small children.
