Bumbo Baby Chair Seat Lawsuit

Bumbo Baby Chair Seat Lawsuit
The Bumbo baby chair was extremely popular from 2007 until 2012. The chair was conveniently available for purchase at multiple store chains including Wal-Mart, Target, Babies R Us, Toys R Us and more. The chairs could generally be purchased for $20 to $50, and they were commonly bought for use in keeping children contained. Unfortunately, the Bumbo baby chair started having complaints against it, and that is when things changed for the Bumbo chair company. Due to the large amount of people affected by the lackluster safety concepts of the chair, our firm has decided to help in receiving financial retribution for injuries that were sustained.

Recalls on the Bumbo Chair

Throughout the course of the chair’s popularity, there were two major recalls for safety concerns with the chairs. The recall that occurred in 2007 was issued because more than 20 infants and toddlers were reported to have sustained injuries up to fractured skulls because they would crawl or fall out of the Bumbo chairs. The injuries sustained were sometimes minor, but they were also sometimes severe. Each case was unique in the placement of injuries, but all fractures occurred on the skulls of the infants.
The injuries that were reported in the 2007 recall were said to have been sustained while the children were in the chair on raised surfaces. The children would slip, crawl or fall out of the seat, and then they would fall from the raised surface. The falls resulted in skull fractures, bruises, cuts, scratches and even burns. While the skull fractures were the more severe cases, the evidence eventually proved that the Bumbo chair was not safe when used on surfaces other than the floor or ground.
In 2012, another recall was issued. This recall stated that children were still sustaining injuries even when not placed on elevated surfaces. The children were sustaining the same injuries including skull fractures, cuts, scratches, bruises and burns. The recall stated that more safety measures needed to be taken to make the chair safer and more reliable to parents, toddlers and infants. It also stated that there needed to be a promotional campaign letting consumers know about the recall and how to get the safety equipment for the chairs.

Safety Measures for the Recalls

During the 2007 recall, the measures that were required were to simply label the chair with a clear label stating the risks of falling on raised surfaces. The manufacturer of the Bumbo seat explained to consumers that the chair was not safe on raised surfaces, they printed new stickers stating this and they sent sticker to consumers asking for them. They still, however, promoted the Bumbo chair in the same way as before. Even the commercials would show an infant in the chair while sitting on a table or dining room chair. Due to the safety risk of this, the company was actually misleading consumers into thinking that it was safe to use in this way.
The 2012 recall was more in depth. Due to consumers reporting the same incidents and injuries at ground level, this recall stated that safety belts needed to be placed in the seats and more warning labels needed to be put on them. The recall also required that the promotional ads showing the elevated seats be removed from the company’s marketing campaign.
The company did abide by these new regulations. They sent notices to all of the stores that sold the chairs, and they sent out safety packages to people inquiring about the. The safety package included the safety belts, new warning labels for the front and rear of the Bumbo chair and instructions on how to properly install and apply all of the materials in the package.

When to File Suit

A child injured from a fall while secured in a baby Bumbo seat has the right to discuss legal action with an attorney. Due to the unsafe nature of the seat, the child and parents are not held responsible for incidents occurring while properly placed in the chair. In order to know whether or not you should file a suit, it is best to speak to a lawyer about your case. While many people are entitled to compensation, there are stipulations that are involved with filing suit in this specific case.
Bumbo chair lawsuits have been popping up across the United States, and more and more victims are coming forward every day. In order to have your case heard in court, it is imperative that you speak to an attorney as soon as possible.

Bumbo baby seats were once extremely popular for new and old parents and grandparents. They were meant to keep children restrained in a comfortable seat while helping the infant sit before he or she was able to sit on her or her own. The chairs quickly started losing popularity when infants started falling and crawling out of them. After two recalls were issued, the manufactures made the necessary safety upgrades to the chairs, but those affected by the unsafe chairs are still eligible for compensation.
