Da Vinci Surgical Robot Lawsuit | Robotic Surgery Lawsuit

Robotic surgery systems are touted as being the next step in medical care. The Da Vinci surgical robot has been used in hundreds of thousands of procedures. Unfortunately, robotic surgery is leading to injuries and even deaths. If you or someone you know has been the victim of a robotic surgery mishap, then you must understand what is happening today with various lawsuits.
The Purpose of Robotic Surgery Systems
Robotic surgery systems like the Da Vinci surgical robot were designed to assist doctors during complex procedures. These systems are large machines with delicate arms that doctors control. The robotic arms interact with the patient and perform the surgery. The robots allow doctors to perform surgery with minimal incisions. They are intended to improve recovery times, reduce the invasiveness of certain operations and lower the risk of complications. Surgical robots also allow doctors to move the artificial arms in ways that human hands and arms cannot so that procedures are easier to complete. These robots were intended to make highly advanced laparoscopic surgeries possible for a range of conditions.
Manufacturers and Marketing
The manufacturers of the Da Vinci system and other surgical robots spent a large amount of money developing the equipment. They marketed the robots to hospitals and doctors aggressively over the course of several years. Instead of marketing the surgical robots as something that will help patients, the manufacturers marketed them as cost saving and time-saving devices. They claimed that the presence of a surgical robot in a hospital would allow that medical center to gain a larger share of the patient market. Many hospitals accepted the marketing from the manufactures and purchased a Da Vinci or other type of surgical robot. The robots were mainly used for laparoscopic procedures like hysterectomies, vasectomies, removing tumors and removing the prostate.
Problems with Robotic Surgery Systems
Problems started to appear with robotic surgery systems soon after they were put into use by hospitals. The causes of the problems were not always clear. Some patients received severe burns during the procedure. Other patients ended up with punctured blood vessels or organs. Lacerations were reported on internal organs. Some robotic surgeries ended with excessive internal bleeding. These problems were not always detected right away. Some caused problems for weeks or months afterwards. A few patients who underwent a procedure utilizing the Da Vinci surgical robot actually died due to punctured organs or internal bleeding. These injuries were almost certainly caused by the robotic surgery system.
Robotic Surgery Lawsuits
Many lawsuits resulted from the numerous injuries and deaths that occurred after using the Da Vinci surgical robot and other systems. The lawsuits were against various parties. The most prominent being the manufacturer of the actual Da Vinci system. The lawsuits accused the manufacturer of producing a defective piece of equipment. There were complaints that the arms were not properly insulated so that electrical currents could contact the patient. This resulted in burns. There were other lawsuits claiming that the entire machine had an inherently defective design. Some lawsuits criticized doctors and hospitals because of a lack of training. The manufacturer provides only two days of training on the system. Some hospitals allowed doctors to use the robotic surgery system on patients after this minimal amount of training.
Why You Should Act If You Have Been Injured
If you or a loved one suffered injuries or death during a procedure involving a robotic surgery system, then you are entitled to act in order to get fair compensation. You have the right to file a lawsuit against the person, company or parties responsible for the injury or wrongful death. You can ask to be financially compensated for any damages that you have incurred.
