It usually starts with phone calls from a collection agency or collection lawyer demanding payment in full of an outstanding debt obligation. Should you consider using a business debt settlement company or a bankruptcy attorney to try and resolve your financial situation? It really depends on the circumstances of your individual case, but obtaining a better understanding of all the available options is definitely your first course of action in this situation. Talk to a knowledgeable professional who can give you all the facts necessary to understand the best solution for you. In order to properly discuss the ins and outs of each option, I’m going to assume for the purpose of this article that you are deciding between hiring an experienced debt settlement person (not you, yourself) and a bankruptcy attorney.
Debt Settlement Agreement
For debt settlement, you (or more likely, a representative working on your behalf) negotiate a reduced lump sum that you agree to pay, and you will get an agreement releasing you from the remaining balance. Debt settlement is a great option for fewer debts at higher balances rather than multiple small debts. It takes preparation and patience and tenacity, and the final product - usually a document titled a Debt Settlement Agreement - is key. What’s nice is you know where you stand at the end because you have something in writing.
The process involves dealing with the collectors and collection agencies and collection lawyers, who can sometimes be hard to work with. Sometimes, it’s difficult to get through to the “right” person. They might be unavailable, or disinterested in your problem, so you must be persistent and stay involved. Usually, they will not assign a particular person to your account. They might not give out email addresses, and they often have thousands of files like your case, so they probably won’t have enough time to give your case the attention it deserves. You have to be the squeaky wheel who gets the grease.
The first offer may be pitched as the best offer, but it’s rarely the best or last offer. You must know when to hang up the phone and when to call them back. If you call back right away, you may look desperate and they may take advantage of that. But you don’t want to wait too long - if you do, the debt might be transferred or turned into a lawsuit that a collection lawyer would file. As long as you know when to hang up and when to call them back, you’ll have a better chance of reaching the lowest number they can agree to.
Pay carefully and only in exchange for a legally enforceable Debt Settlement Agreement. Otherwise you may face unnecessary tax, continued collection, or the debt being sold again. If you want to clear your credit report, you need documentation showing the debt was paid. Settlement will hurt your credit. Seek advice from an experienced professional, or lawyer, before attempting a debt settlement on your own. Remember: DIY debt settlement is not the same thing as a debt settlement company.
Consolidation companies aren’t the same as debt settlement companies. They are typically unknown and unproven companies based outside of your state. Beware of consolidators, as they usually have high upfront fees, take years to complete, and damage your credit. These consolidation plans often require monthly deductions taken directly from your account. Some plans fall through months or years later, leaving you with higher bills and a potential lawsuit from the collection lawyer. The creditors would have to agree to the terms, which means it is not a guarantee they would all agree, leaving you without the full resolution you sought out for. Sometimes the companies abandon the customer at the first sign of a lawsuit, or pass you on to the lawyer that cannot help you.
Bankruptcy Attorneys
On the other hand, bankruptcy is often the best way to deal with overwhelming debt, especially if you qualify for a full discharge under Chapter 7. You will be released from all dischargeable unsecured debts without repayment. Student loan debt, child support and most tax debt are not dischargeable. The creditors do not have to cooperate, and you do not have to negotiate a settlement. It provides an automatic stay of all creditors, and will put a stop to foreclosures, collection lawsuits, wage garnishments, repossessions, bank attachments.
Personal assets can be protected. There are no negative tax consequences like with debt settlement. Your credit score is improved in bankruptcy, as all negative reporting is stopped. Debt to income ratio is fixed. Bankruptcy attorneys often report that their clients recover from bankruptcy sooner than from settlement or consolidation. It is often the faster and more affordable one-stop solution. It’s a statute passed by congress specifically to deal with debt.
In Short
So, in short, how is debt settlement different from bankruptcy? Debt settlement only works if the creditor agrees - and they might not. There is no guarantee. Bankruptcy does not rely on the approval of creditors. Bankruptcy is a global discharge of your entire dischargeable unsecured debt portfolio in one fell swoop (minus student loans, child support or most tax debt). Debt settlement is piecemeal by debt - usually fewer debts, bigger dollar amounts. In settlement, the burden of calling, waiting, writing, dealing with collectors and collectors’ lawyers falls on the individual or someone they have hired. The debt may be sold or a lawsuit filed while you attempt settlement. Bankruptcy imposes an automatic stay. A debt settlement that is not documented correctly may bring with it a higher tax bill, or more collection, or the debt getting sold again. Bankruptcy does none of those things.
So which call should you make? It depends. If you only have a few debts, but they are high balances, and you have some creditors willing to negotiate with you, and can deal with the hit on your credit report, and the work to document things, consider a settlement company. If you need relief now from collection efforts, or the creditors are not willing to work with you, or simply the debt is overwhelming, consider a bankruptcy attorney. But whichever route, you should seek the advice from an experienced professional before you make a decision. What seems right to someone on paper can be wrong for you.
